Am I Entitled To Severance Pay in Ontario?
Under Ontario’s Employment Standards Act (ESA), severance pay compensates employees whose employment is terminated in certain circumstances (often without cause) are entitled to severance pay in almost all cases.
It’s based on factors like length of service and regular wages (and can consider bonuses or commissions if applicable).
There are exceptions — and many employees may also be entitled to common law reasonable notice beyond ESA minimums.
If you were let go, check your entitlement to see where you stand.

Frequently Asked Questions About Severance Pay
Do you get severance if you quit?
Usually not — but if your employer made significant changes to your job (such as a pay cut, reduced hours, or a demotion) and you resigned because of it, this could be constructive dismissal. In that case, you may still be entitled to severance under Ontario law.
What is included in a severance package?
A severance package can include wages, benefits, vacation pay, bonuses, and references. Always review with an employment lawyer before signing — we can assess fairness and risk.
Do I need a severance lawyer?
A lawyer can identify legal issues, value your claim, and negotiate improvements — with Faircomp Law, there are no upfront fees.
Understanding Severance Pay in Ontario
The termination process isn’t always straightforward.
Knowing your rights under the ESA — and when you may be entitled to more under common law — helps you secure fair compensation.
Legal Framework
Minimum entitlements fall under the ESA (e.g., termination without cause, workplace closure, significant business changes). Many employees may be owed more under common law based on age, position, and tenure.
How Severance is Calculated
ESA severance uses years of service and regular wages. Common law can yield higher compensation depending on multiple factors. We’ll explain both and show where your case fits.
Exceptions & Enhanced Packages
Some exceptions apply (e.g., misconduct). Employers often offer enhanced packages to reduce risk — we’ll review and negotiate on your behalf.
Review Before You Sign
Releases waive your right to sue. Don’t feel pressured to sign immediately — get a review so you understand your options.
